TERMS OF SALES

Article 1- Scope of the terms and conditions of sale
These general terms and conditions of sale apply by operation of law to any sale of tour guide services.
The sale is deemed to have been concluded on the date of the written agreement accepting the terms of sale and payment between Secrets d'Artisans Japonais, in the person of Julie BAUD, and the customer.
Any order implies unreserved acceptance of these terms and conditions of sale and payment, which prevail over all other conditions, except those expressly accepted by Secrets d'Artisans Japonais.

All terms and conditions of the website are subject to Japanese law, based on the Japanese Specific Trade Law (特定商取引法に基づく表示).


Article 2- Ordering
Any service or reservation, to be valid, must be established by a sales contract in the form of an estimate or email sent by Secrets d'Artisans Japonais, approved by the customer in written form.

Please note that we are unable to process email requests for changes or refunds received after the above opening hours. Please note the time difference with Japan!


 

Article 3- Services
In addition to the acceptance of these General Terms and Conditions, which govern the relationship between Secrets d'Artisans Japonais and the Customer, the latter must, at the time of each order, read and accept the general terms and conditions of sale of the Partner with whom the contract is concluded.
Secrets d'Artisans Japonais offers the Customer the possibility of creating a “tailor-made” holiday program, according to his/her tastes and desires, including visits and experiences, the rental of a tourist car with driver as well as escort and guide services or other services.
Secrets d'Artisans Japonais thus provides the Customer with suggestions for destinations, itineraries and tourist services in order to define the outlines of his stay and his budget.


Article 4- Reservations
To obtain a “tailor-made” holiday offer, the Customer sends a request for a quote to Secrets d'Artisans Japonais by filling in the contact form accessible on the Site or directly by email.
Secrets d'Artisans Japonais will then propose to the Customer an exhaustive program with an indicative price. This program and the price may be modified to better suit the customer's request, for a maximum of 3 proposals.

If none of the 3 proposals is accepted by the Customer, a payment of 15% of the amount of the last quote will be requested. The purpose of this sum is to compensate Secrets d'Artisans Japonais for the time spent working on the stay proposals.

Once the program has been validated by the customer, Secrets d'Artisans Japonais will send a detailed program as well as the firm and definitive price, all fees, taxes and services included.
- If the customer is an individual: The previous email will be accompanied by a payment link for 50% of the total price, valid for one week. The booking will only be considered valid once full payment has been received.
- If the customer is a travel agent: The booking is considered valid upon written or verbal confirmation of the program and/or date of service, and payment of 15% of the total amount on account. An invoice in the name of his company will be issued at the end of the service for the remaining payment.

To finalize the order, the customer must provide the following information no later than one week before the tour:
Name and surname of participants;
Address or billing information;
E-mail address;
Telephone number.
Secrets d'Artisans Japonais will then reserve all the services making up the tour in the name and on behalf of the Customer.

The deadline for completing the service request depends on the schedule and deadline agreed between Secrets d'Artisans Japonais and the customer.

If the reservation is not confirmed at least one week (private customer) or 3 days (travel agent) before the tour, the tour will be automatically cancelled.

Article 5- Price
The final price will be defined in the quote sent by email, which must be approved in writing by the customer.
The full amount of the invoice must be paid on acceptance of the quote, no later than 2 weeks before the start of the tour (with some exceptions).
All services include VAT.

No reservation can be confirmed and no invoice issued without full payment on acceptance of the quotation.
Secrets d'Artisans Japonais reserves the right to modify its prices at any time. However, it undertakes to invoice the service at the price indicated when the order is placed.

 

Overtime
Overtime will be charged if requested at the last minute, during the same service, and must be paid for in cash at the time of request. Secrets d'Artisans Japonais reserves the right to refuse overtime.

Article 6- Terms of payment
Payment is to be made by credit card directly on our booking platform or by bank transfer.

- If the customer is a private individual: Payment for the entire tour must be made at least 2 weeks before the tour departure date.
- If the customer is a travel agent: The deposit must be paid at least 1 week before the start of the tour. The remainder of the invoice must be paid by the last day of the month following tour departure.

An invoice can be given to the individual customer on request at the end of each guide service; ask for it by e-mail: juliebaud.contact [at] gmail.com

Article 7 - Modification & cancellation of reservation
Any modification concerning the characteristics of the guided tour (timetable, content, number of people, etc.) must be notified as soon as possible and will be taken into account subject to the availability and capacity of the guide. If necessary, additional charges may apply.

a) Cancellation attributable to Secrets d'Artisans Japonais
Secrets d'Artisans Japonais undertakes to be present at the date, time and place specified at the time of booking. In the event of force majeure or exceptional circumstances preventing Secrets d'Artisans Japonais from providing the service (illness or accident), Secrets d'Artisans Japonais must inform the customer by any means necessary. The customer, without prejudice to any claims for damages, will be reimbursed without penalty for any sums paid.

b) Cancellation by the customer
Cancellation charges:
Up to 30 days before tour departure: full refund.
Up to 7 days before departure: 85% refund.
Between 7 days and 48 hours before departure: 50% refund.
Less than 48 hours before departure: no refund.

The customer must ensure that he/she is at the appointment time and place before the tour starts. If the customer cancels after the scheduled appointment time, or fails to show up at the meeting point, no refund will be made.
If there is no news from the customer, the guide will wait for the customer for 30 minutes after the appointment time specified on the confirmation. After 30 minutes, the guide reserves the right to cancel the service without refund.

In the event of a delayed landing of a flight in Japan or a missed connection, Secrets d'Artisans Japonais will do its best to postpone the service by the same amount, unless one or more partners are unavailable.

c) Force majeure
The service providers reserve the right to cancel any reservation in the event of force majeure and to change the date. This applies in particular to strikes involving means of transport, demonstrations, hotel staff, climatic conditions (bad weather, storms, etc.), land conditions (earthquakes, floods, etc.), closure of establishments and geographical conditions, etc. If the service provider is obliged to cancel the activity before the customer has had a chance to start, the customer will be offered the option of postponing the activity.

In specific, justified cases (supporting documents requested), refund conditions may be reviewed on a case-by-case basis.

Article 8 - Refund
If the clauses authorize the reimbursement of the service(s), this will take place within a maximum of 15 days from the date of retraction.

Article 9 - Disputes / Claims
Secrets d'Artisans Japonais cannot be held responsible for any inappropriate behavior on the part of its customers during the guided tour or escort service, nor for any damage caused to the property of third parties.
In the event of a claim, the parties will attempt to reach an amicable agreement. In the event of dispute, the general terms and conditions of sale are subject to Japanese law. Any dispute relating to their interpretation and/or execution shall be submitted to the Japanese courts.

Article 10 - Jurisdiction
In the absence of an amicable settlement within a maximum of 3 months, any dispute arising out of or in connection with the validity, interpretation or performance of these GTCS shall be subject to the jurisdiction of the Courts of Nagoya.

The entire GTC of the site are subject to Japanese law, based on the Japanese law on commercial transactions (特定商取引法に基づく表示, Notification based on Specific Trade Law).
